TERMS AND CONDITIONS

 

Maintenance/customer Service:

 

          We've engineered your Sterilaser™ Disinfection Unit to require minimum

maintenance over its life. While no training, implementation or support services are included with the purchase of any Sterilaser™ Disinfection Unit, should you encounter a problem, or if you have additional questions about your Sterilaser™ Disinfection Unit not covered in the manual or online, please call Sterilaser™ customer service at (800) 726-4099.

 

LIMITED WARRANTY:

 

Two-year Limited Warranty:

 

          All Sterilaser™ Disinfection Units carry a limited two year warranty from the date of purchase and includes only normal use. The warranty is granted only to the original purchaser and their authorized operators. Please keep your sales receipt or other document showing proof of purchase. Keep the original box and packing material in case you need to return your product.

 

          During the two-year warranty period, if your Sterilaser™ Disinfection Unit has been operated and maintained according to the owner's manual instructions, Sterilaser, LLC will, at its option, repair or replace any defects in material or workmanship free of charge. This warranty specifically excludes the UVC lamps after one year from the date of purchase because the lamps must be replaced annually. This warranty also specifically excludes product repair or replacement because of misuse, accident, unauthorized repair or alteration or any other causes not within the control of Sterilaser, LLC. This warranty applies only while this product is in use in the United States.

 

WARRANTY LIMITATIONS:

 

OTHER THAN THE LIMITED WARRANTY SET FORTH ABOVE, STERILASER™ NEITHER MAKES NOR GRANTS ANY WARRANTY, REPRESENTATION, OR CONDITION, EXPRESSED OR IMPLIED. STERILASER™ EXPRESSLY EXCLUDES AND DISCLAIMS ANY WARRANTIES AND ALL IMPLIED WARRANTIES, REPRESENTATIONS AND CONDITIONS INCLUDING WITHOUT LIMITATIONS, ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PURPOSE, PARTICULAR, SPECIFIC OR OTHERWISE.

 

PURCHASER’S SOLE AND EXCLUSIVE REMEDY FOR ANY DAMAGE ARISING FROM THE USE OR OPERATION OF THE STERILASER PRODUCT SHALL BE LIMITED TO THE REPAIR OR REPLACEMENT OF THE PRODUCT, AT THE SOLE DISCRETION OF STERILASER™, REGARDLESS OF WHETHER SAID DAMAGE ACCRUES AS A CONSEQUENCE OF PERSONAL INJURY, PRODUCT LIABILITY, WRONGFUL DEATH/SURVIVAL ACTION DAMAGES, BYSTANDER DAMAGES, PROPERTY DAMAGE, EMOTIONAL DISTRESS, MENTAL PAIN AND ANGUISH, SUBORDINATION CLAIMS, LOST WAGES, LOSS OF EARNING CAPACITY, ANY LOSS OF SERVICES, LOSS OF CONSORTIUM, LOSS OF SOCIETY, LOVE AND COMPANIONSHIP, FUNERAL AND BURIAL EXPENSES, LOSS OF INHERITANCE, ACTUAL DAMAGES, COURT COSTS, ATTORNEYS' FEES, EXEMPLARY DAMAGES.

 

IN NO EVENT SHALL STERILASER™ BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES PURCHASER MAY INCUR IN CONNECTION WITH THE PURCHASE AND OR USE OF THE STERILASER™ DISINFECTION UNIT.

 

          This warranty gives you specific legal rights and you may also have other rights, which vary from state to state. For warranty service, please call Sterilaser, LLC at (800) 726-4099.

 

GENERAL

 

Construction:

          These terms and conditions shall be construed and interpreted in accordance with the laws of Michigan.

 

Survivability:

          In the event it is determined that any portion of these Terms and Conditions are unenforceable or invalid, all remaining provisions not so determined shall maintain their full force and effect.

 

Jurisdiction and Forum:

          All parties agree that the state courts of Oakland County, Michigan shall have exclusive jurisdiction over all parties and subject matter with regard to any dispute arising out of the use, operation and or these Terms and Conditions requiring judicial resolution.
